Supreme Court to Determine Whether Trump Can Claim Presidential Immunity

The Supreme Court will consider arguments Thursday that determine whether former President Donald Trump can claim presidential immunity against criminal charges. Special Counsel Jack Smith – appointed by the controversial Merrick Garland — has charged Trump with conspiracy to defraud the U.S. and obstruction of an official proceeding for his role in the January 6th controversy.

The Supreme Court decision could determine whether Trump faces a federal trial this year on four counts. Trump has pleaded not guilty and is seeking immunity. It’s a complicated case pitting accountability against a president’s protection in carrying out their duties of office.

Joining us now to discuss the trial is Michael Letts, a law enforcement veteran with over 30 years of experience under his belt. Letts is President, Founder, and CEO of InVest USA, an organization that provides bulletproof vests to police officers through various charitable groups and sponsorships.

Welcome, Michael.

1. What are the federal charges against Donald Trump?

2. Do they have any merit?

3. Is Trump correct – that he should be protected against such charges by presidential immunity?

4. Is it telling that Merrick Garland appointed Jack Smith, who brought these charges against Donald Trump?

5. Is it troubling that we could see back-to-back trials against a candidate for president during an election year?

6. Trump’s legal team argues a denial of immunity would adversely affect future presidents and their ability to make decisions. Do you agree?

7. What can we look for from the Supreme Court as they hear this case?

8. How do you believe the Supreme Court will rule?
